Information from Gale Corbett Hutchinson, 44, who has a lengthy criminal history, led Watkins to hand off his constable investigation to a special prosecutor. The DA?s Office said it asked for an outside prosecutor since Watkins is an apparent victim of the alleged scheme to drive him from office.
Hutchinson, of Allen, is being held in the Collin County jail on numerous felony charges including making false statements for property credit, credit card abuse, theft and impersonating a lawyer.
Ted B. Lyon, a Mesquite personal injury attorney and former Democratic state legislator, was asked by the district attorney's office to take over its constable investigation. A state district judge appointed Lyon on Wednesday.
Lyon is also charged with looking into the allegations from Hutchinson regarding Danny Defenbaugh, the investigator hired last year by county commissioners to look into the employment practices of Constables Jaime Cortes and Derick Evans.
Cortes said Hutchinson claimed that Defenbaugh instructed him to ?make things up about myself and DA?s office.?
... Defenbaugh, a former FBI agent, said Hutchinson reached out to him in about March or April with information he said he had about Cortes that was damaging. Defenbaugh said his investigation for the county was done at the time and that he referred Hutchinson to the FBI. Hutchinson, he said, was hoping to cut a deal.
?He was running from the law and wanted to keep from going to jail,? he said.
... First Assistant District Attorney Terri Moore offered no details of the alleged scheme when she announced the special prosecutor appointment on Wednesday.
